Request
I would like to know the following in relation to the existence of a memorandum of understanding between the Police and Crime Commissioner and the prison service/local prison governor:
- Does the Commissioner have a memorandum of understanding (MOU) with the prison service or your local prison governor, which defines
- what an “assault on a prison officer” is and
- the types of incidents suitable for prosecution?
- If a MOU or other similar document exists, please provide a copy of the actual document by email.
- If a MOU is not held by the Police and Crime Commissioner’s office, I would be grateful if you would advise me who is now responsible for these. I understand these agreements were previously held by the Police Authorities.
Please note, if this document is not known as a “memorandum of understanding”, please provide details of whatever document you have which defines what an “assault on a prison officer” is and the incidents deemed suitable for prosecution.

I write in connection with your request for information which was received by the Police and Crime Commissioner for North Yorkshire on 11 November 2013. I note you seek access to the above information:
Extent and Result of Searches to Locate Information
To locate the information relevant to your request searches were conducted within the Office of the Police and Crime Commissioner. Legal Services serves both the Commissioner and North Yorkshire Police, searches have also been carried out with the Prison Liaison Officer for North Yorkshire Police, to avoid having to formally transfer your request.
I can confirm that there is no information held by the Commissioner or North Yorkshire Police in response to your request, as there is no such memorandum containing the definition of “assault on a prison officer”.
